The Agent can not have more Authority than the Principal

A quick review to again re-establish that We the People are the Principal and government is Our Agent.

Sovereignty itself is, of course, not subject to law, for it is the author and source of law; but in our system, while sovereign powers are delegated to the agencies of government, sovereignty itself remains with the people, by whom and for whom all government exists and acts.
Supreme Court - Yick Wo v. Hopkins, 118 U.S. 356 (1886)

Article 1, Section 1 of the U.S. Constitution

All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

  • Sovereignty remains with the people.
  • The people are the author and source of law.
  • Sovereign powers are delegated.
  • All legislative Powers herein granted...
  • All legislative Powers herein consented to by the Sovereign People.
  • This is the only document of Law delegating power.
  • These are the only powers delegated.
  • It is OUR POWER that is delegated to the government.
  • Government is OUR Agent, we are the Principals.

I can delegate authority to you to borrow my car.  I can do this because it is my car.  It is Property I own; I may use it; do with it what I please; so long as I don't interfere with another Citizen's Rights to Life, Liberty, or Property.  This is my Power and Authority. This is the Power and Authority that I may delegate to another.

I can NOT delegate authority to you to borrow my neighbor's car. I can NOT do this because it is NOT my car.  It is NOT Property I own. I may NOT use it, NOR may I do what I please with it.  I do NOT have Power and Authority over that car.  I can NOT delegate a Power or Authority that I do NOT have.

I can NOT wantonly steal another's property, therefore I can NOT delegate power to another to do the same in my name.  I am NOT allowed to interfere with another's Liberty, therefore I can NOT authorize another to do so on my authority.  I can NOT offensively take another's Life, NOR can I take another's life in revenge or punishment, therefore no Agent of mine has that power either.

Two things are constructed out of this truth:

First:  Since I have "Unobstructed action according to my will ... within the limits drawn ... by the equal rights of others" meaning other's Rights of Life, Liberty, and Property, I am LIMITED by that boundary.  This means any Agent (which also includes the government) that acts on my behalf is LIMITED by that boundary also.

Second:  Conversely, any right of action that the government or officer of the government have, I have as well.  I have the same authority to wear a side arm as any police officer, since it is my delegated Sovereign authority as the Creator of the subservient government which allows any police officer to officially carry a sidearm in the first place.
